Music reduces pain in fibromyalgia (FM), a chronic pain disease, but the functional neural correlates of music-induced analgesia (MIA) are still largely unknown. We recruited FM patients ( n = 22) who listened to their preferred relaxing music and an auditory control (pink noise) for 5 min without external noise from fMRI image acquisition. Resting state fMRI was then acquired before and after the music and control conditions. A significant increase in the amplitude of low frequency fluctuations of the BOLD (...) signal was evident in the left angular gyrus (lAnG) after listening to music, which in turn, correlated to the analgesia reports. The post-hoc seed-based functional connectivity analysis of the lAnG showed found higher connectivity after listening to music with right dorsolateral prefrontal cortex (rdlPFC), the left caudate (lCau), and decreased connectivity with right anterior cingulate cortex (rACC), right supplementary motor area (rSMA), precuneus and right precentral gyrus (rPreG). Pain intensity (PI) analgesia was correlated ( r = 0.61) to the connectivity of the lAnG with the rPreG. Our results show that MIA in FM is related to top-down regulation of the pain modulatory network by the default mode network (DMN). (shrink)

This paper explores two persistent questions in the literature on presumptions: the place and the nature of presumptions in law and legal argumentation. These questions were originally raised by James Bradley Thayer, one of the masters of the Law of Evidence and the author of the classic chapter devoted this subject in A preliminary treatise on Evidence. Like Thayer, I believe that these questions deserve attention. First the paper shows that the connection between presumptions and argumentation is a constant feature (...) in the literature on presumptions, since its foundation in the Middle Ages to modern times. James Bradley Thayer was probably the last jurist who clearly saw that presumptions belong to argumentation. Second, the paper examines two sources of controversy in the language of presumptions. First, “presumption” is an ambiguous word in the legal discourse. As a result, it is almost impossible to provide a clear and succinct answer to the question “What is a presumption?”. Second, there are at least four reconstructions of the concept of presumption whose merits and shortcomings are relevant to explore. The analysis presented here may be of interest for legal and non-legal scholars and, hopefully, it may help to shed light on the possibilities and limits of an interdisciplinary dialogue about presumptions. There are possible artificially intelligent beings who do not differ in any morally relevant respect from human beings. Such possible beings would deserve moral consideration similar to that of human beings. Our duties to them would not be appreciably reduced by the fact that they are non-human, nor by the fact that they owe their existence to us. Indeed, if they owe their existence to us, we would likely have additional moral obligations to them that we don’t ordinarily owe to (...) human strangers – obligations similar to those of parent to child or god to creature. Given our moral obligations to such AIs, two principles for ethical AI design recommend themselves: (1) design AIs that tend to provoke reactions from users that accurately reflect the AIs’ real moral status, and (2) avoid designing AIs whose moral status is unclear. Since human moral intuition and moral theory evolved and developed in contexts without AI, those intuitions and theories might break down or become destabilized when confronted with the wide range of weird minds that AI design might make possible. Research on moral cleansing and moral self-licensing has introduced dynamic considerations in the theory of moral behaviour. Past bad actions trigger negative feelings that make people more likely to engage in future moral behaviour to offset them. Symmetrically, past good deeds favour a positive self-perception that creates licensing effects, leading people to engage in behaviour that is less likely to be moral. In short, a deviation from a is balanced with a subsequent action that compensates the prior behaviour. We model (...) the decision of an individual trying to reach the optimal level of moral self-worth over time and show that under certain conditions the optimal sequence of actions follows a regular pattern which combines good and bad actions. To explore this phenomenon we conduct an economic experiment where subjects play a sequence of giving decisions (dictator games). We find that donations in the previous period affect present decisions and the sign is negative: participants' behaviour in every round is negatively correlated to what they did in the past. Hence donations over time seem to be the result of a regular pattern of self-regulation: moral licensing (being selfish after altruistic) and cleansing (altruistic after selfish). (shrink)

We propose four policies of ethical design of human-grade Artificial Intelligence. Two of our policies are precautionary. Given substantial uncertainty both about ethical theory and about the conditions under which AI would have conscious experiences, we should be cautious in our handling of cases where different moral theories or different theories of consciousness would produce very different ethical recommendations. Two of our policies concern respect and freedom. If we design AI that deserves moral consideration equivalent to that of human beings, (...) that AI should be designed with self-respect and with the freedom to explore values other than those we might impose. We are especially concerned about the temptation to create human-grade AI pre-installed with the desire to cheerfully sacrifice itself for its creators’ benefit. (shrink)

Este trabalho analisa a influência tributária na definição do modelo constitucional de atribuição dos resultados econômicos da exploração do petróleo offshore, no Brasil. Além da abordagem constitucional do tema, destaca-se a participação dos entes federativos estaduais nas rendas da produção de petróleo, sua federalização e, em decorrência, a redução das rendas dos entes federativos subnacionais, implicando num movimento compensatório pela via da utilização de elementos de natureza tributária, tais como o extinto Imposto Único sobre Minerais e o regime constitucional especial (...) de cobrança na origem do ICMS devido nas operações de combustíveis e derivados de petróleo. We perform an experimental investigation using a dictator game in which individuals must make a moral decision —to give or not to give an amount of money to poor people in the Third World. A questionnaire in which the subjects are asked about the reasons for their decision shows that, at least in this case, moral motivations carry a heavy weight in the decision: the majority of dictators give the money for reasons of a consequentialist nature. Based on the results (...) presented here and of other analogous experiments, we conclude that dicator behavior can be understood in terms of moral distance rather than social distance and that it systematically deviates from the egoism assumption in economic models and game theory. Every so often an experiment trying to give reliable evidence for a metallic hydrogen solid is reported. Such evidence is, however, not too convincing. As Eric Scerri has recently reiterated, “the jury is still out on that issue” . This search stems from the common spectroscopy shared by the hydrogen atom and all the alkali metal atoms, and perhaps is guided by a desire to place hydrogen atop the alkali metals, in Mendeleiev’s Table, reinforced by the fact pointed out by (...) Scerri that there is no other obvious place for hydrogen in said Table. But H2 is a light gas at room temperature, while Li, Na, K and the other alkali elements form solid metal crystals. At very low temperatures, of course, hydrogen solidifies, but it is formed by H2 molecules . Our purpose here is to use a new argument to break this impasse: “should H be grouped with the alkali metals with which it shares a common spectroscopy, but which solidifies in a completely different fashion?” This argument has been proposed before in a couple of papers in this journal to establish a similar question for He and the alkaline earths , as is discussed in “Precedents” section. Objective: To evaluate moral development as an indicator of the capacity to consent among two groups of patients from the Hospital de Clínicas in Porto Alegre, RS, Brazil.Method: Fifty-nine adolescents and 60 patients over 60 years of age participated in a cross-sectional study to assess moral development using Loevinger’s model of ego stages.Results: Age and moral development showed no association, with most participants in the two groups being in the conscientious phase.Conclusions: Age is probably not an adequate variable to measure (...) decision-making capacity, because questions of medical consent relate to participants’ own personal health. Decision-making capacity should be viewed as a continuous function. While the age of the person whose consent is needed should be considered, age alone, from a moral perspective, is not the main determinant of this capacity. (shrink)

The principle of overlap of classes holds that when two entities interface, the effect is a blurring of boundaries between conceptual territories. In this paper, this question is in order: Is Folk Catholicism an instance of overlap of classes? If Folk Catholicism is not construed as such, these fallacies – using Robin George Collingwood’s perspective in his An Essay on Philosophical Method, may unfold: the fallacy of precarious margins, the fallacy of identified coincidents, and the fallacy of false disjunction. The (...) first fallacy holds that the ‘Folk’ in Folk Catholicism has no contribution to how ‘Catholicism’ unfolds. The second fallacy maintains that the extensions of both ‘Folk’ and ‘Catholicism’ are clearly delineated. The third fallacy underscores that Folk and Catholicism are mutually exclusive terms. When such fallacies are accepted, this paper holds that Folk Catholicism as a construct may be a contradiction of terms on what it means to be Folk and Catholic. This is the illogical consequence given that the truth of what it means to be folk necessitates the falsity of what it means to be Catholic and vice-versa. However, when recognized from the lens of the overlap, Folk Catholicism is construed as a term that evolves and is historically conditioned. (shrink)

An initial study of Robin George Collingwood's The Principles of Art and Benedetto Croce's Aesthetic: A Science ofExpression and General Linguistic gives an immediate impression that Collingwood appropriated and incorporated many elements in Croce's work to his own position. This is probably the main reason why Collingwood, in his correspondence with Croce, sincerely expressed his gratitude to the Italian Philosopher for laying the foundation of his art-theory. Collingwood's acknowledgement of Croce's influence and the apparentsimilarity in their theories on art disposes (...) us to wonder if Collingwood mayhave only extended, hence, reiterated the principles of Croce's position. Given this impression, the present article hopes to provide a study between Collingwood's and Croce's theories of art in the hope that we can tease out a crucial difference between their standpoints. If we can demonstrate a significant difference, then we may have provided ourselves with the cudgels to assert that Collingwood's theory of art is also unique. (shrink)

We look at two fundamental logical processes, often intertwined in planning and problem solving: inference and update. Inference is an internal process with which we uncover what is implicit in the information we already have. Update, on the other hand, is produced by external communication, usually in the form of announcements and in general in the form of observations, giving us information that might not have been available (even implicitly) before. Both processes have received attention from the logic community, usually (...) separately. In this work, we develop a logical language that allows us to describe them together. We present syntax, semantics and a complete axiom system; we discuss similarities and differences with other approaches and mention how the work can be extended. (shrink)

Background: Coronavirus disease 2019 has resulted in an increase in known risk factors for mental health problems. Mexico adopted lockdown and physical distancing as a containment strategy with potential consequences on day to day life, such as social isolation, loss of income and loneliness that can have important consequences in terms of mental health.Objective: We aimed to examine the effect of the initial phases of the COVID-19 pandemic on psychological distress, well-being and perceived physical health among Mexican-base respondents and to (...) examine whether coping strategies would play a potential intermediating role in relation to these variables. Under the Existential Positive Psychology perspective, an emphasis was made on meaning-centered coping.Methods: A cross-sectional study was conducted between April 30 and June 16th 2020 among 604 Mexicans-base respondents of which 471 were women and 132 men. Data was collected by using online questionnaires. Psychological distress was measured using the Depression, Anxiety, and Stress Scale. The Brief COPE Inventory was used to assess problem-focused and emotion-focused coping strategies. We also used the Meaning-Centered Coping Scale. PERMA-Profiler was used to assess well-being, perceived physical health, and loneliness. Profiler and Descriptive analyses and bivariate linear regression were performed to examine the association of variables.Results: 45.9% of the participants reported moderate to extremely severe psychological distress. Our results demonstrate that problem-focused and emotion-focused coping were positively related to psychological distress, whereas meaning-centered coping was negatively associated with distress. Furthermore, psychological distress played a potential negative role in the perceived physical health, while meaning-centered coping and well-being buffered the negative influence of psychological distress on perceived physical health (completely standardized indirect effect = –0.01, SE: 0.012, 95% CI [−0.065; −0.017].Conclusion: Meaning-centered coping was found to suppress the negative influence of psychological distress on sensation of decreased physical health corroborating the critical role of meaning in life in promoting well-being. Future studies can further examine the value of the critical role of meaning in life in promoting well-being as a protective factor against severe distress during traumatic events. Findings of this study can be used to orient policies and interventions aimed to alleviate suffering in the midst of the COVID-19 pandemic. (shrink)

Two stages of the creative writing process were characterized through mobile scalp electroencephalography in a 16-week creative writing workshop. Portable dry EEG systems with synchronized head acceleration, video recordings, and journal entries, recorded mobile brain-body activity of Spanish heritage students. Each student's brain-body activity was recorded as they experienced spaces in Houston, Texas, and while they worked on their creative texts. We used Generalized Partial Directed Coherence to compare the functional connectivity among both stages. There was a trend of higher (...) gPDC in the Preparation stage from right temporo-parietal to left anterior-frontal brain scalp areas within 1–50 Hz, not reaching statistical significance. The opposite directionality was found for the Generation stage, with statistical significant differences restricted to the delta band. There was statistically higher gPDC observed for the inter-hemispheric connections AF07–AF08 in the delta and theta bands, and AF08 to TP09 in the alpha and beta bands. The left anterior-frontal recordings showed higher power localized to the gamma band for the Generation stage. An ancillary analysis of Sample Entropy did not show significant difference. The information transfer from anterior-frontal to temporal-parietal areas of the scalp may reflect multisensory interpretation during the Preparation stage, while brain signals originating at temporal-parietal toward frontal locations during the Generation stage may reflect the final decision making process to translate the multisensory experience into a creative text. With the 1999 film The Martix as its point of departure, this work explores the meaning of ‘reality’ outside the scope of empirical positivism. Drawing on the phenomenological epistemology of the interplay of noetic and noematic dimensions of experience postulated by Husserl, and on the works of Heidegger and Merleau-Ponty, this work considers how the reality of our experience derives not from some correspondence to a universal ‘objective’ point of view, but from our concernful involvement with our lived world as (...) the horizon of our lived and known projects. Finally, in light of Ricoeur’s work on imagination and productive reference, this work considers whether and on what grounds the distinction between so called ‘real’ and ‘virtual’ experiences is meaningful. This paper compares Heidegger’s “dasein-centric” existential hermeneutic to Levinas’s primacy of the Other and the importance the latter places on the ethical relationship. Invoking the concepts of totality and infinity, the paper discusses the ways in which one encounters the Other and how signification arises from the ethical relationship. This is followed by a discussion of how Levinas’s ethics might influence existential phenomenological research methodology, pointing to the ethical demands described by Levinas as seeming to have priority over the praxis (...) of research insofar as the Other calls us beyond the methodological framework. Finally, the paper considers the extent to which the ethical demands of Levinas’s phenomenology are met by the special place of the research participant and the attitude of empathic presence prescribed within the Heideggerian framework. Nature connectedness is determined by the representation individuals have about themselves within nature. This concept is often studied in relation to the direct contact individuals have with natural environment, which according to some studies have demonstrated to generate positive effects by fostering a feeling of connecting and bonding with nature, as well as improving their wellbeing. The main focus of this study was to calculate and assess the relation between Nature Connectedness and wellbeing of participants. The methodological approach of this (...) research reaches quantitative data comparing results obtained from both samples, as well as correlations between the variables. The sample for this study was composed by two groups of university students. Both contrast group and experience group filled the questionnaire in two separate moments and in different environments. First data collection moment for both groups was held inside a university classroom. A second moment of data collection was carried out after a month from the first application, having the contrast group answer the questionnaire on a classroom again whilst the experience group responded it during an excursion to Isla Del Tiburon in Northwestern Mexico after performing some recreational activities being totally immersed in a local desertic environment. Questionnaire was composed by a 6 point Likert type scale measuring Nature Connectedness through concepts such as Nature relatedness and Love and care for the natural, as well as Subjective and Psychological Wellbeing of participants. Results show that both wellbeing and Nature Connectedness are positively influenced by performing activities out in the natural environment. This work was also conducted in response to the need to understand the full extent of Contact and Connectedness to nature, carrying out an exploratory study in desertic settings when much of the early work centers around the study of these variables in green nature environments.
